Welcome to Whispering Vegan! We're so excited for you to enjoy our ethical, plant-based bakes and mindful digital products. To ensure everyone has a smooth and joyful experience, here are a few sweet and simple terms and conditions. By placing an order or using our services, you agree to these guidelines:
1. Scope of Agreement
These terms apply to all transactions and interactions with Whispering Vegan, including physical bakes and goods, digital products from the Whispering Pixels brand, use of our website (https://whisperingvegan.co.za), and participation in our programs.
2. Allergens & Dietary Needs
While all our products are proudly 100% vegan (free from animal products like dairy, eggs, and honey), we handle common allergens like nuts, soy, gluten, and other ingredients in our kitchen in Montana, Pretoria.
Your Responsibility: It is your responsibility to inform us of any allergies or specific dietary requirements at the time of placing your order.
Cross-Contamination: While we take immense care to prevent cross-contamination, we cannot guarantee a complete absence of trace allergens. We encourage customers with severe allergies to exercise caution.
3. Order Confirmation & Changes (Physical Products)
All orders are subject to availability and confirmation. Once confirmed, changes or cancellations may not always be possible, especially for custom or large orders, as we start preparing ingredients fresh for you. Please confirm all details carefully when ordering.
4. Pricing & Payment
Currency: All prices are listed in South African Rands (ZAR).
Payment: Full payment is required at the time of order confirmation unless otherwise agreed upon for larger corporate or event orders.
5. Price Changes
Please note that our products are freshly made with high-quality ingredients. Due to potential fluctuations in ingredient prices, our product prices may change from time to time without prior notice. We strive to keep our prices fair and competitive while reflecting the true cost of our artisanal vegan bakes.
6. Quality, Freshness, & Storage
We bake everything with love and the freshest ingredients! Our products are best enjoyed within a recommended timeframe, which will be advised upon delivery or collection. We cannot be held responsible for the quality of products if they are not consumed or stored according to our recommendations.
7. Delivery, Collection, & Risk
We offer three ways to get your treats:
Collection (Montana, Pretoria): Products are available for collection during our operating hours (Monday–Friday 09H00-17H00, Saturday 09H00-13H00). Risk of loss or damage passes to you upon collection.
Local Delivery (Scheduled Areas in Pretoria): Risk of loss or damage passes to you upon successful hand-off at your specified delivery address.
Courier (Non-Perishables Only): We use third-party couriers for non-perishable products. This option excludes items like cakes, cupcakes, breads, and tarts. Risk of loss or damage passes to you the moment the courier collects the package from us. We are not liable for delays, damage, or loss caused by the courier service.
8. Cancellations & Refunds
Physical Products: In the unlikely event that you need to cancel an order, please contact us as soon as possible. Refunds will be handled on a case-by-case basis, considering the amount of preparation already undertaken. Custom orders are generally non-refundable once preparation has begun.
Digital Products (Whispering Pixels): Given the nature of digital goods, all sales are considered final once the product has been downloaded or access has been granted. We do not offer refunds on digital products unless required by applicable law.
9. Product Appearance
Our handcrafted treats may vary slightly in appearance from images shown on our website or social media – that's the beauty of artisanal baking! While we strive for accuracy, the colors and decoration may have minor variations.
10. Digital Products (Whispering Pixels) & Licensing
All digital products (wallpapers, e-books, etc.) are sold for personal, non-commercial use only unless otherwise stated in the product description. You may not resell, redistribute, or share the original digital files with others.
11. Agent Program
Participation in the Whispering Vegan Agent Program is governed by a separate agreement. By enrolling in the program, you agree to the specific terms and conditions, commission structure, and rules outlined on the Agent Program page.
12. Using the Group or Forum at Own Risk
If our website features a community group or forum, participation is at your own risk. While we endeavor to foster a positive and respectful environment, Whispering Vegan is not responsible for the content posted by other users or for any interactions that occur within the group. We encourage members to exercise caution and good judgment when sharing personal information or engaging with others.
13. Events Displayed on Our Website
Our website may display information about various events. Please be aware that while we strive to provide accurate information, Whispering Vegan is not the organizer of all listed events and therefore cannot be held liable for any changes, cancellations, or incidents that may occur at these events. We recommend verifying all event details with the respective organizers.
14. Intellectual Property
The content on our website, including the Whispering Vegan and Whispering Pixels names, logos, original recipes, text, graphics, digital products, and designs, are the property of Whispering Vegan.
